Terms of Service

Welcome to Flyxel. These Terms of Service ("Terms") apply to your use of getflyxel.com (the "Site") and to any order you place with Flyxel ("Flyxel," "we," "us," or "our"). Please read them carefully.

1. Acceptance of these Terms

By visiting the Site or placing an order, you agree to these Terms and to our Refund & Replacement Policy, Shipping Policy, and Privacy Policy, which are part of these Terms. If you don't agree, please don't use the Site.

2. Using our online store

Flyxel sells only to customers in the United States and ships only to U.S. addresses. To place an order, you must be at least 18 years old or the age of majority where you live. You agree to provide accurate, current, and complete information when you order, and to use the Site only for lawful purposes.

3. Product information

We try to describe and show our products as accurately as we can. Colors and details may look slightly different depending on your screen, and photos and videos are for illustration. Products are sold in their standard packaging.

4. Prices

All prices are shown in U.S. dollars. Shipping within the United States is free. Any applicable sales tax is calculated and shown at checkout. Prices and availability may change at any time without notice, but changes won't affect orders we have already accepted.

5. Orders

After you place an order, you'll receive an email confirming that we've received it. Please check your order carefully before submitting it, including your color, quantity, and shipping address.

We may decline or cancel an order when it's reasonably necessary, for example if a product is unavailable, if there is an error in the price or product information, if we can't verify your payment or order details, or if we suspect fraud or unauthorized activity. If we cancel an order you've already paid for, we'll refund the full amount you paid for it.

6. Payment

Payment is due when you place your order. Payments are processed securely by third-party payment providers through our Shopify checkout, and Flyxel does not receive or store your full payment card number. By submitting an order, you confirm that you're authorized to use the payment method you provide.

7. Shipping

Orders are prepared and dispatched within approximately 2–4 calendar days after the order is placed. Once your order has been dispatched, estimated delivery takes approximately 6–8 days. Delivery timeframes are estimates, not guaranteed delivery dates. Full details are in our Shipping Policy.

If we're unable to ship your order within the stated processing time, we'll notify you and give you the option to cancel for a full refund, in line with applicable U.S. law.

8. Handoff to the carrier and risk of loss

Flyxel's responsibility is to properly prepare your order and properly hand it over to the shipping carrier. Once a properly fulfilled order has been accepted by the carrier, transportation and final delivery are controlled by the carrier, not by Flyxel.

To the maximum extent permitted by applicable law, the risk of loss associated with transportation passes to you once your order has been properly handed over to the carrier. For the following issues, you agree to contact the shipping carrier directly, using the tracking information provided with your order:

  • Lost packages
  • Delayed packages
  • Delivery attempts
  • Tracking issues
  • Packages marked as delivered
  • Carrier misdelivery
  • Theft after delivery
  • Other carrier-related problems

Flyxel does not provide refunds or free replacements for carrier-related losses that occur after proper handoff, and is not obligated to open or manage carrier claims on your behalf, except where applicable law requires otherwise.

9. All sales are final; replacements

All sales are final. We don't accept returns, exchanges, or refunds for a change of mind, ordering the wrong color or version by mistake, personal preference, misuse, or damage that happens after delivery.

If you receive a defective product, the wrong product, or the wrong color because of our error, or if your order is affected by another error caused directly by Flyxel, email contact@getflyxel.com within 7 days of delivery with your order number, clear photos, a video when relevant, and a short explanation. Approved claims are normally resolved with a replacement at no additional cost, not a refund. Full details are in our Refund & Replacement Policy.

10. Product use and safety

Flyxel products are flying products with moving parts and rechargeable batteries. Please read and follow the instructions included with your product before using it, fly in a clear area away from faces, pets, and fragile objects, and supervise children while the product is in use.

Like any flying product, a Flyxel can be damaged by:

  • Crashes and impacts
  • Incorrect handling or improper use
  • Water
  • Improper charging
  • Modifications
  • Failure to follow the instructions

Damage caused by misuse, accidents, or improper handling is not a product defect and is not eligible for a free replacement. You are responsible for using the product safely and in line with any laws or rules that apply where you use it.

11. No separate warranty

Flyxel does not offer a separate, voluntary product warranty after delivery, and no manufacturer's warranty is provided through Flyxel. What we do offer for product defects and order errors is described in our Refund & Replacement Policy. To the maximum extent permitted by applicable law, Flyxel makes no other warranties about its products or the Site. Nothing in these Terms excludes or limits any warranty or consumer right that cannot be excluded or limited under applicable law.

12. Your responsibilities

You are responsible for:

  • Providing a complete and accurate shipping address and contact details
  • Reviewing your order before you submit it
  • Following your shipment's tracking and contacting the carrier about delivery issues
  • Checking your product when it arrives and reporting any eligible product problem within 7 days of delivery
  • Using the product safely and as instructed

13. Limitation of liability

To the maximum extent permitted by applicable law, Flyxel will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or our products. To the maximum extent permitted by applicable law, Flyxel's total liability for any claim related to an order will not exceed the amount you paid for that order.

Some states don't allow certain limitations of liability, so some of these limits may not apply to you. Nothing in these Terms limits liability that cannot be limited under applicable law.

14. Intellectual property

The Site and its content, including the Flyxel name, logo, text, graphics, images, videos, and design, are owned by or licensed to Flyxel and are protected by intellectual property laws. You may use the Site for personal, non-commercial purposes only. You may not copy, reproduce, distribute, or create derivative works from our content without our written permission.

15. Prohibited uses

You agree not to use the Site to:

  • Break any applicable law or regulation
  • Place fraudulent orders or use a payment method without authorization
  • Infringe our intellectual property rights or anyone else's
  • Upload or transmit viruses or other malicious code
  • Interfere with or get around the Site's security features
  • Scrape or collect data from the Site without permission
  • Submit false or misleading information

We may refuse service to anyone who violates these Terms.

16. Third-party services

Our store is hosted on Shopify, which provides the ecommerce platform we use to sell our products. We also rely on other third-party providers, such as payment processors and shipping carriers, and the Site may link to third-party websites. These third parties operate under their own terms and privacy policies, and Flyxel is not responsible for their content, services, or practices.

17. Errors and inaccuracies

Occasionally the Site may contain typographical errors, inaccuracies, or omissions related to product descriptions, pricing, availability, or shipping times. We may correct errors and update information at any time, and we may cancel an order affected by an error, including after it has been submitted. If we cancel a paid order, we'll issue a full refund.

18. Governing law

These Terms and any order you place are governed by the laws of the State of Wyoming, United States, subject to applicable federal law and any mandatory consumer protection laws that cannot legally be waived. If any part of these Terms is found to be unenforceable, the rest of the Terms will remain in effect.

19. Changes to these Terms

We may update these Terms from time to time. The current version will always be posted on this page with the date it was last updated. Updated Terms apply to orders placed after they are posted.
